1. Who we are and why your brand appears on Kaicus
Kaicus is a Spanish price comparison platform that displays offers supplied via third-party catalogs with which we have affiliation agreements (networks and performance marketing agencies). These partners are authorized to publish their own catalogs, which may include items bearing your brand. The inclusion of these products:
- Does not imply any direct contractual relationship with the brand.
- Is based on publicly available data or data provided by affiliates.
- Is solely intended to offer the consumer objective, accurate, and transparent information.
2. Legal basis for publication
Before detailing the regulations, we summarize the European and Spanish provisions that legitimize your brand’s presence on Kaicus and govern our role as a digital intermediary:
| Regulation | Article / key concept | Application to Kaicus |
|---|---|---|
| GDPR (EU) 2016/679 | Art. 6(1)(f) – legitimate interest | We process non-personal catalog data for the legitimate purpose of informing the user. |
| Directive 2000/31/EC – LSSI-CE 34/2002 | Art. 14 (hosting) and Arts. 15-17 LSSI | Kaicus acts as a passive intermediary; we respond to valid notifications received. |
| Digital Services Act (Reg. EU 2022/2065) | Arts. 9-11 – notice-and-action | Internal takedown procedure based on “sufficient and reasoned” information. |
| Directive 2019/790/EU | Art. 17 – use of third-party content | Coverage to link and make affiliate catalogs available to the public. |
| Trademark Act (RDL 23/2018) | Arts. 34-39 – exclusive rights | Removal only when there is real risk and the brand provides unambiguous identifiers (EAN/GTIN). |
3. Benefits for brands
By appearing in our comparison tool, your brand gains tangible advantages in visibility and performance, including:
- Incremental visibility with users in an advanced purchase phase.
- Qualified traffic: clicks redirect to the store selling your product.
- Transparent comparison highlighting competitive prices and promotions.
- Cost-free promotion: third-party remuneration only upon sale or validated action.
4. Product removal request
If you wish to remove your brand totally or partially, we need the unique identifiers (EAN and/or GTIN) of the affected items.
Why do we request the EAN/GTIN?
Catalogs we receive from partners arrive in heterogeneous formats (CSV, XML, JSON) and often contain variations in the brand name: abbreviations, typos, or differences in case. The EAN/GTIN is a unique numeric code assigned worldwide by GS1 that unequivocally identifies each commercial item. Without this data, there is a risk of:
- Removing products that do not belong to your brand (over-blocking).
- Keeping visible references that should be removed.
- Harming legitimate distributors or other similar brand owners.
How EAN/GTINs are registered: companies obtain a range of GS1 prefixes and assign a unique code to each SKU. That code accompanies the product throughout its commercial life and is valid in all retail and wholesale channels.
- Compile the detailed list of EAN/GTINs for each item to be removed.
- Send the request to the contact address indicated on our website, specifying whether the removal is permanent or temporary.
Standard response time: we confirm receipt within ≤ 48 h and usually resolve within ≤ 7 working days, in accordance with the LSSI-CE and the DSA.
5. Possible consequences of removal
Before requesting deletion, consider the commercial and competitive effects it may entail:
| Impact for the brand | Description |
|---|---|
| Loss of visibility | Reduced exposure in comparison searches and organic results. |
| Reduction in clicks and referred sales | Decrease in qualified traffic to retailers selling your products. |
| Competitive advantage for other brands | Competitors will remain visible in the same category. |
6. Future brand inclusions
Affiliates may add new products of your brand in the future. If your exclusion request remains, we will apply the previously communicated EAN/GTIN filters; otherwise, we will need you to update the list.
7. Disclaimer and good faith
We maintain a firm commitment to act with transparency and diligence. To this end, we rely on the following principles:
- We do not modify or alter descriptions, prices, or images received from affiliates.
- We respond diligently to valid notifications, maintaining auditable records of all communications.
- We reserve the right to reject generic requests that do not allow for unequivocal identification of the affected products, pursuant to Art. 16 LSSI-CE and Art. 9 DSA.
8. Contact and complaints channel
For any questions or to exercise your rights (removal, correction, clarification), send an email to the address indicated in the Contact section of this site.
Communications will be retained, with a timestamp, as proof of diligence and to comply with European regulations.
